General Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
- Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;
- Day: calendar day;
- Long-term transaction: a distance contract concerning a series of products and/or services, where the delivery and/or take-up obligations are spread over time;
- Durable data carrier: any medium that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows for future consultation and unchanged reproduction of the stored information;
- Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
- Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;
- Distance contract: a contract concluded within the framework of a system organized by the entrepreneur for distance selling of products and/or services, using one or more techniques for remote communication up to and including the conclusion of the contract;
- Remote communication technique: a means that can be used to conclude a contract, without the consumer and entrepreneur being in the same room simultaneously;
- General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order between entrepreneur and consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be reviewed at the entrepreneur’s premises and will be sent free of charge to the consumer upon request.
If the distance contract is concluded electronically, the text of these general terms and conditions may, contrary to the previous sentence, be made available electronically to the consumer in such a way that it can be stored easily on a durable data carrier. If this is not reasonably possible, it will be indicated before the distance contract is concluded where the general terms and conditions can be reviewed electronically and that they will be sent free of charge electronically or otherwise upon request.
If, in addition to these general terms and conditions, specific product or service conditions apply, the second and third paragraphs apply accordingly, and the consumer can always invoke the provision that is most favorable to them in the event of conflicting general terms and conditions.
If one or more provisions in these general terms and conditions are at any time wholly or partially null and void or are annulled, the remaining provisions of the agreement and these terms and conditions will remain in effect, and the relevant provision will be replaced promptly by a provision that closely approximates the intent of the original provision. Situations not covered by these general terms and conditions should be assessed ‘in the spirit’ of these general terms and conditions.
Ambiguities regarding the interpretation or content of one or more provisions of our terms and conditions should be explained ‘in the spirit’ of these general terms and conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
The offer is non-binding. The entrepreneur is entitled to change and adjust the offer.
The offer contains a complete and accurate description of the offered products and/or services. The description must be detailed enough to allow the consumer to make a proper assessment of the offer. If the entrepreneur uses images, these are a truthful representation of the offered products and/or services. Apparent mistakes or errors in the offer do not bind the entrepreneur.
All images, specifications, and data in the offer are indicative and cannot be the basis for compensation or dissolution of the agreement.
Images of products are a truthful representation of the offered products. The entrepreneur cannot guarantee that the colors displayed exactly match the actual colors of the products.
Each offer contains such information that it is clear to the consumer what the rights and obligations are associated with accepting the offer.
This includes, in particular:
- the price, excluding customs duties and import VAT. These additional costs will be borne by the customer. The postal and/or courier service will use the special scheme for postal and courier services with respect to import. This scheme applies when goods are imported into the destination EU country, which is the case here. The postal and/or courier service collects VAT (possibly together with the customs duties charged) from the recipient of the goods;
- any shipping costs;
- the way in which the contract will be concluded and what actions are necessary for this;
- whether or not the right of withdrawal applies;
- the method of payment, delivery, and execution of the contract;
- the period for accepting the offer, or the period within which the entrepreneur guarantees the price;
- the height of the rate for remote communication if the costs of using the technique for remote communication are calculated on a basis other than the regular base rate for the used communication method;
- whether or not the agreement will be archived after its conclusion, and if so, how the consumer can consult it;
- the way in which the consumer can check and, if desired, correct the data provided by him in the context of the agreement before concluding the agreement;
- any other languages in which, in addition to Dutch, the agreement can be concluded;
- the codes of conduct to which the entrepreneur is subject and how the consumer can consult these codes electronically; and
- the minimum duration of the distance contract in the case of a long-term transaction.
Optional: available sizes, colors, types of materials.
Article 5 – The Agreement
The agreement is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and fulfillment of the conditions set for this.
If the consumer has accepted the offer electronically, the entrepreneur will promptly confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer can dissolve the agreement.
If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures.
The entrepreneur may – within legal limits – inform themselves whether the consumer can meet their payment obligations, as well as any facts and factors that are relevant to a responsible conclusion of the distance agreement. If the entrepreneur, based on this investigation, has good reasons not to enter into the agreement, they are entitled to refuse an order or request, or to attach special conditions to the execution.
The entrepreneur will send the following information with the product or service to the consumer, in writing or in such a way that it can be stored by the consumer on a durable data carrier:
- the visiting address of the entrepreneur’s establishment where the consumer can go with complaints;
- the conditions under which and the manner in which the consumer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
- information about warranties and existing after-sales service;
- the data included in Article 4, paragraph 3 of these terms and conditions, unless this information has already been provided to the consumer before the execution of the agreement;
- the requirements for termination of the agreement if the agreement has a duration of more than one year or is of indefinite duration.
In the case of a long-term transaction, the provision in the previous sentence only applies to the first delivery.
Every agreement is entered into under the suspensive condition of sufficient availability of the relevant products.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the option to dissolve the agreement without giving reasons within 14 days. This cooling-off period begins the day after the consumer or a representative designated by the consumer who is known to the entrepreneur receives the product.
During the cooling-off period, the consumer will handle the product and the packaging with care. They will only unpack or use the product to the extent necessary to determine if they want to keep the product. If they exercise their right of withdrawal, they will return the product with all delivered accessories and – if reasonably possible – in the original condition and packaging to the entrepreneur, according to the reasonable and clear instructions provided by the entrepreneur.
If the consumer wishes to exercise their right of withdrawal, they must notify the entrepreneur within 14 days of receiving the product. The notification must be made by means of a written statement/email. After the consumer has notified their wish to exercise the right of withdrawal, the consumer must return the product within 14 days. The consumer must prove that the delivered items have been returned in time, for example by means of proof of shipment.
If the customer has not notified their wish to exercise the right of withdrawal within the periods mentioned in paragraphs 2 and 3 or has not returned the product to the entrepreneur, the purchase is final.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, the costs for returning the products are for the consumer’s account.
If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal. This is provided that the product has already been received by the retailer or proof of complete return can be provided.
Article 8 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the consumer’s right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, or at least in a timely manner before the conclusion of the agreement.
Exclusion of the right of withdrawal is only possible for products:
- that have been manufactured
according to consumer specifications, for example custom-made products or products that are clearly personal in nature;
- that cannot be returned due to their nature, for example products that spoil or age quickly;
- whose price is subject to fluctuations in the financial market that the entrepreneur has no influence on;
- for individual newspapers and magazines;
- for audio and video recordings and computer software of which the consumer has broken the seal.
Article 9 – The Price
During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes as a result of changes in VAT rates.
Notwithstanding the previous paragraph, the entrepreneur may offer products or services whose prices are subject to fluctuations in the financial market and over which the entrepreneur has no influence, with variable prices. The offer will indicate this type of fluctuations and the fact that any mentioned prices are target prices.
Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of legal regulations or stipulations.
Price increases from 3 months after the conclusion of the agreement are only permitted if the entrepreneur has stipulated this and:
- they are the result of legal regulations or stipulations; or
- the consumer has the authority to terminate the agreement as of the day on which the price increase takes effect.
The prices stated in the offer of products or services include VAT.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products and/or services meet the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability, and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement.
A guarantee provided by the entrepreneur, manufacturer, or importer does not affect the rights and claims that the consumer can assert against the entrepreneur under the agreement.
Article 11 – Delivery and Execution
The entrepreneur will take the greatest possible care when receiving and executing orders for products and when assessing applications for the provision of services.
The place of delivery is the address that the consumer has communicated to the entrepreneur.
With due observance of what is stated in Article 4 of these general terms and conditions, the entrepreneur will execute accepted orders promptly but no later than 30 days, unless a different delivery period has been agreed. If delivery is delayed, or if an order cannot be executed or only partially executed, the consumer will be informed of this no later than 30 days after placing the order. In this case, the consumer has the right to terminate the agreement free of charge and is entitled to any compensation.
After termination in accordance with the previous paragraph, the entrepreneur will promptly refund the amount paid by the consumer.
The risk of damage and/or loss of products rests with the entrepreneur up to the moment of delivery to the consumer or a representative designated in advance and made known to the entrepreneur, unless explicitly agreed otherwise.
Article 12 – Payment
Insofar as not otherwise agreed, the amounts owed by the consumer must be paid immediately at the time of the conclusion of the agreement, or at least within 14 days after the start of the cooling-off period. In the case of an agreement to provide a service, the consumer will have to pay no later than 14 days after the agreement is concluded.
The consumer has the obligation to immediately report any inaccuracies in provided or stated payment details to the entrepreneur.
In the event of non-payment by the consumer, the entrepreneur has the right, subject to legal restrictions, to charge reasonable costs incurred in advance.
Article 13 – Complaints Procedure
The entrepreneur has a sufficiently notified complaints procedure and handles the complaint according to this complaints procedure.
Complaints about the execution of the agreement must be submitted to the entrepreneur promptly, fully, and clearly described, after the consumer has discovered the defects.
Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within 14 days with a notice of receipt and an indication of when the consumer can expect a more comprehensive answer.
If the complaint cannot be resolved in mutual consultation, a dispute arises that is subject to the dispute resolution procedure.
Article 14 – Disputes
Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
Article 15 – Additional or Deviating Provisions
Additional or deviating provisions from these general terms and conditions may not be to the consumer’s detriment and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner.

Algemene Voorwaarden
Artikel 1 – Definities
In deze algemene voorwaarden wordt verstaan onder:

Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht;

Consument: de natuurlijke persoon die niet handelt in de uitoefening van een beroep of bedrijf en een overeenkomst op afstand aangaat met de ondernemer;

Dag: kalenderdag;

Duurtransactie: een overeenkomst op afstand met betrekking tot een reeks van producten en/of diensten, waarvan de leverings- en/of afnameverplichtingen in de tijd zijn gespreid;
-
Duurzame gegevensdrager: elk middel dat de consument of ondernemer in staat stelt om informatie die aan hem persoonlijk is gericht, op te slaan op een manier die toekomstige raadpleging en ongewijzigde reproductie van de opgeslagen informatie mogelijk maakt;

Herroepingsrecht: de mogelijkheid voor de consument om binnen de bedenktijd af te zien van de overeenkomst op afstand;
-
Ondernemer: de natuurlijke of rechtspersoon die producten en/of diensten op afstand aan consumenten aanbiedt;
-
Overeenkomst op afstand: een overeenkomst die wordt gesloten in het kader van een door de ondernemer georganiseerd systeem voor verkoop op afstand van producten en/of diensten, waarbij tot en met het sluiten van de overeenkomst uitsluitend gebruik wordt gemaakt van één of meer technieken voor communicatie op afstand;

Techniek voor communicatie op afstand: een middel dat kan worden gebruikt voor het sluiten van een overeenkomst, zonder dat consument en ondernemer gelijktijdig in dezelfde ruimte zijn samengekomen;

Algemene Voorwaarden: deze algemene voorwaarden van de ondernemer.

Artikel 3 – Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke tot stand gekomen overeenkomst op afstand en bestelling tussen ondernemer en consument.
De tekst van deze algemene voorwaarden wordt vóór de totstandkoming van de overeenkomst op afstand aan de consument beschikbaar gesteld. Indien dit redelijkerwijs niet mogelijk is, zal voordat de overeenkomst op afstand wordt gesloten, worden aangegeven dat de algemene voorwaarden bij de ondernemer zijn in te zien en op verzoek kosteloos aan de consument worden toegezonden.
Indien de overeenkomst op afstand elektronisch wordt gesloten, kan de tekst van deze algemene voorwaarden, in afwijking van het vorige lid, langs elektronische weg aan de consument ter beschikking worden gesteld op zodanige wijze dat deze door de consument op een eenvoudige manier kan worden opgeslagen op een duurzame gegevensdrager.
Specifieke product- of dienstvoorwaarden die naast deze algemene voorwaarden gelden, worden in geval van tegenstrijdigheden beoordeeld in het voordeel van de consument.
Artikel 4 – Het Aanbod
Wanneer een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk vermeld. Het aanbod is vrijblijvend en kan worden aangepast door de ondernemer.
Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden producten en/of diensten. Eventuele afbeeldingen zijn een waarheidsgetrouwe weergave. Kennelijke vergissingen of fouten binden de ondernemer niet.
Artikel 5 – De Overeenkomst
De overeenkomst komt tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de gestelde voorwaarden.
Indien de consument het aanbod elektronisch heeft aanvaard, bevestigt de ondernemer direct de ontvangst van de aanvaarding. Zolang de ontvangst niet is bevestigd, kan de consument de overeenkomst ontbinden.
Bij elektronische betaling neemt de ondernemer passende veiligheidsmaatregelen.
Artikel 6 – Herroepingsrecht
De consument kan binnen 14 dagen zonder opgave van redenen de overeenkomst ontbinden. De bedenktijd gaat in op de dag na ontvangst van het product.
Tijdens de bedenktijd dient de consument zorgvuldig met het product om te gaan en het alleen uit te pakken of te gebruiken voor zover nodig om de aard en kenmerken vast te stellen.
Artikel 7 – Kosten bij Herroeping
De kosten voor retourzending zijn voor rekening van de consument. De ondernemer zal het betaalde bedrag binnen 14 dagen na herroeping terugbetalen, mits het product ontvangen is.
Artikel 8 – Uitsluiting Herroepingsrecht
Het herroepingsrecht kan worden uitgesloten voor:

Op maat gemaakte of gepersonaliseerde producten;

Bederfelijke goederen;
-
Producten waarvan de prijs afhankelijk is van marktfluctuaties;
-
Audio- en videoproducten waarvan de verzegeling is verbroken.
